Our terms and conditions for using DMWare hosting services

These terms and conditions of service govern the contractual relationship between DM di Masserini Davide, located at via Provinciale, 82 Albino (BG), VAT: 03558220160 also referred to in this document as "Ware" or "Provider", and the Customer for the provision of digital products and services provided.
Basic Support: Basic Support includes support operations offered free of charge for the services offered. These are configuration interventions, preference settings or other small interventions provided to the Customer to help them manage their active services and fix any operational or optimization problems.
Premium Support: Premium support includes paid support, optimization, repair or any other type of service operations on the services offered.
Registration Authority: The entity that manages the registration of one or more domain extensions. For example, the Registration Authority for .it domains is the Italian NIC.
Best Effort: The term "Best Effort" indicates a way of offering assistance by trying to do the maximum to complete an operation in the shortest possible time, but does not guarantee at all that the operation will be completed within an established time, nor the way or success of the operation.
Data: Content, information and files present in a virtual space that resides on a device.
Extensions: Any software installed in the web space in question, by way of example but not exhaustive CMS, plugins, components, modules, templates or frameworks.
MoR (Merchant of Records): Legal entity responsible for the sale of goods or services to the final consumer. It handles payments and takes all related tax and bureaucratic obligations related to the transaction.
Mission Critical: Systems, rules and procedures extremely important for the correct functioning of software or a computer system and which therefore require management times and costs of much higher magnitude than standard methods.
Parties: The Customer and the Ware company.
Payment Processors: It is one of the available payment methods. Today Ware has the possibility to receive payments through bank transfer, Paypal and Stripe. Different payment methods such as Amazon Pay, Satispay, WooCommerce Payments, Paddle.com or others could be activated by Ware for specific Customers, products or special services.
Quarantine: Virtual space where email messages marked as "potentially dangerous" or "spam" are transferred for a predetermined period of time and then completely deleted if not transferred by the Customer to a different space.
Paid Order: An order is marked as "paid" when Ware detects and records payment through the transactional methods available on the reference date.
Specifically, for payments by bank transfer, check, Paypal, Stripe, WooCommerce Payments, Amazon Pay, Satispay, the order can be marked as paid after actual receipt of payment.
Registrar: The Registrar is a private organization that offers domain registration and management, sometimes in collaboration through Registries, i.e. private, governmental or semi-governmental entities that have the authorizations and management capabilities of one or more domain extensions.
Service: The functionality provided as described on the Provider's official website.
Useful Time: For the activation and renewal of Products and/or Services, the useful time is the amount of time needed to:
The useful time is 7 working days. Renewals made beyond the Useful Time cannot guarantee the Customer timely renewal of the Service.
Ware uses some national and international Registrars in order to register, administer and renew one or more domains for the Customer. The registration of a domain name takes place respecting the chronological order of orders received and paid. Unpaid orders that require domain registration cannot be processed and may be canceled if the amount due is not paid within 7 days of the order activation date.
The successful outcome of the registration is subject to its acceptance by the competent Registrar and Registry for the chosen extension.
A domain that appears free during the order phase may no longer be available at the time of actual registration because in the time between when the order was placed by the Customer and when a Provider staff member initialized the domain registration procedure, someone else may have registered the same domain with precedence.
The domain registration service is registered in the name of the Customer to assign ownership of the domain itself. Any inaccuracies or omissions by the Customer during the order phase will slow down the registration process as our staff will be required to request the missing information from the Customer.
To ensure the regular conduct of the domain registration practice, it is necessary to indicate during the order phase all the information that follows:
Domain registration is maintained until the contract expires. As the contract expiration approaches, Ware will send notices to the email address associated with the Customer's account. It is the Customer's responsibility to ensure the accuracy of their account email address on the Ware site, that email messages from Ware are not classified as "junk mail" or are blocked from receiving the message for any reason. Ware may also notify the Customer through other means such as SMS, WhatsApp, Telegram or telephone, without however being obliged to do so.
For faster management of the registered domain, Ware will use an internal email address dedicated to the Customer, as the Registrant email (example: companysmith@dmware.com).
In the event that a domain has not been renewed within the useful time relative to expiration, the domain name and the services associated with it are suspended and placed in "status" of different duration depending on the extension. Each registered extension has its own dedicated policy that may receive changes over time. Generally all domain extensions have at least two stages following expiration:
To recover a domain in "Pending delete / Redemption period" status, it is necessary to pay a penalty imposed by the Registrar, which varies based on the domain extension. The recovery cost of a .it domain is € 45.00 + VAT and for a .com domain € 120.00 + VAT. Recovery costs for other extensions are variable. Each service provided has a duration equal to that indicated in the order form.
Ware services are not renewed in "tacit renewal" mode. Customers who rely on automatic payments through "Payment processors" have the advantage of automatic transaction, however it is necessary that they themselves check its successful outcome.
At the time of renewal, the prices of the price list updated to the expiration date and the other contractual conditions active at the time of renewal will apply.
The Customer accepts that on the expiration date of each Service the Parties will be automatically free from their respective obligations.
The Customer acknowledges and accepts that it constitutes his exclusive burden to procure and maintain a copy of the data and/or information and/or content processed through the Service, as once the Contract has ended or the Service has expired such data and/or information and/or content may no longer be recoverable. The Customer may request one-time or periodic provision of a total or partial copy of their account data, an operation that may be paid.
Unless specifically agreed between the Parties, payment of the Service fee as indicated in the price list must be made by the Customer simultaneously with sending the order and in any case in advance with respect to the activation or renewal of the service.
The payment made by the Customer will show an identification number or string. Ware will issue the related electronic invoice within a few days of receiving payment.
For Italian Customers, the due VAT will be applied to all invoiced amounts which, together with any other tax burden deriving from the execution of the Contract, will be borne by the Customer. The Customer relieves Ware of any responsibility arising from transactions or payments made.
The Customer has the possibility to make one or more payments to Ware by bank transfer, VISA debit or credit card, MasterCard, American Express, Diners, JCB, Discover Card, China UnionPay, Maestro or cryptocurrency through Coinbase. In case of local customers, it is possible to make payments in cash or check under pre-established agreements.
Below are some indications on payment methods:
The Customer acknowledges and accepts that registering a domain name involves inserting their personal data into a publicly accessible register kept at the competent Registration Authority for the chosen extension.
The Customer can check within 15 (fifteen) days from the domain registration date the accuracy of their data in the database of the competent Authority for the chosen extension; in case within this period the Customer does not raise any exception regarding the correctness of their data, these will be considered correct.
Ware provides assistance to all Customers who report any problems through the channels described on the page https://dmware.com/contact.
In such case the Customer authorizes Ware and the possible companies commissioned by it to carry out the necessary technical intervention.
Ware, at its discretion, reserves the right to suspend or interrupt the Service, even without any notice in case:
The Customer may exercise the right of withdrawal within fourteen days from the date of completion of the Contract without any penalty and without indicating the reasons.
In case of exercise of the right of withdrawal, Ware will refund the Customer, within 30 days from the day on which the intention to withdraw from this contract was communicated, all payments received, minus the costs incurred and/or to be incurred, in accordance with applicable law.
Any email account offered by Ware includes an antivirus and antiphishing system aimed at identifying dangerous messages. Emails marked as suspicious may contain malware and/or phishing attempts and are therefore discarded or rejected to the sender's server.

Any purchase or communication that occurred outside the domains listed above is not to be considered valid and could represent an attempted scam or fraud.
From March 10, 2025 on an experimental basis, the possibility of making payments and renewals through cryptocurrency has been introduced. The Customer has the possibility to purchase and renew services through our website that uses the Coinbase Commerce gateway.
Ware offers its services and products to Customers outside the Italian territory through the Merchant of Records (MoR) Paddle.com. The purchase of services can take place on the website https://play-ware.com or https://ware.international. All terms, conditions of use and privacy policy and data processing can be viewed on the official website https://paddle.com.
